Our general terms and conditions of sale
Preamble
These general terms and conditions of sale are concluded by and between the Domaine de la Lieutenante, SCEA, with a capital of €1,524, having its registered office at Route Du Vallon, 13310 Saint Martin de Crau, registered in the Tarascon trade and companies register under number D 414 121 186, hereinafter referred to as "Domaine de la Lieutenante," of the one part, and any natural or legal person wishing to proceed to a purchase via the website www.lalieutenante.com, hereinafter referred to as the “Buyer,” of the other part.
Purpose
The purpose of these general terms and conditions is to define the contractual relations between the Domaine de la Lieutenante and the Buyer, and the conditions applicable to all sales carried out via the website www.lalieutenante.com, whether the buyer is a professional or a consumer.
The acquisition of a product through this site entails acceptance of these general terms and conditions of sale by the Buyer without reservation.
These general terms and conditions of sale shall take priority over any other general or particular terms and conditions not expressly approved by the Domaine de la Lieutenante.
The Domaine de la Lieutenante reserves the right to amend the general terms and conditions at all times. In such a case, the applicable terms and conditions shall be those in force on the date on which the Buyer placed the order.
The Buyer who proceeds to make a purchase on the website www.lalieutenante.com declares that he has the full legal capacity to do so. It shall accordingly be up to the legal representative of a minor or a n adult protected within the meaning of Article 1124 of the Civil Code, to complete the registration form or to authorise expressly the minor to complete said form.
Products on offer
The products for sale shall be those indicated on the website www.lalieutenante.com. Such products shall be on offer for as long as stocks last.
The photographs and texts on www.lalieutenante.com shall not fall under the scope of the contract. Under no circumstances may the Domaine de la Lieutenante be held liable if the photographs are not perfectly similar or if there are errors in the texts.
Prices
The prices indicated on www.lalieutenante.com are inclusive of all taxes, in euros, taking account of the VAT applicable on the day the order is placed. Any change in rate may be passed on to the price of the products.
The Domaine de la Lieutenante reserves the right to change its prices at all times, whereby the price on the site on the date that the order is placed shall nonetheless be the only one applicable to the Buyer.
The prices indicated do not include shipping charges, which shall be invoiced in addition thereto and shall be specified to the Buyer when his order is confirmed.
Orders
The automatic registration systems of the Domaine de la Lieutenante shall be relied upon as proof of the content of the order and its date.
After going over his order, and once all the information requested has been provided by the Buyer, the latter shall click on the method of payment selected to confirm his order. Confirmation of the order by the Buyer shall entail acceptance of these general terms and conditions and the waiver of the Buyer’s own or any other conditions of sale. The Domaine de la Lieutenante shall communicate the confirmation of the order by e-mail. The sale shall be concluded only after such confirmation.
The Domaine de la Lieutenante reserves the right to cancel any order by a Buyer with which it is engaged in litigation relating to a previous order.
Terms of payment
The price shall be payable when the order is placed. All orders shall be payable in euros.
All browsing on the site www.lalieutenante.com is secure (Secure Socket Layer (SSL) protocol).
The Buyer can pay by bank card, transfer or cheque.
For payments by transfer or cheque, the order will be shipped only when payment has been actually received.
For payments by bank card, the Buyer shall be redirected to the secure environment of Banque Populaire. The bank card number and various types of information are entered directly on the secure servers of Banque Populaire. The Domaine de la Lieutenante cannot access those servers under any circumstances. The Domaine de la Lieutenante only receives a consent or refusal of payment from Banque Populaire. In case of refusal, the order will be cancelled automatically.
Deliveries
Deliveries shall be made at the address indicated by the Buyer when the order is placed. This address may be situated only in the following delivery regions: Mainland France, Monaco, Andorra, all the countries of the European Union, Switzerland and Norway.
The risks shall be transferred when the product is handed to the forwarder. Products shall thus travel at all times at the Buyer’s risk. In case of damage during transport, the reservations noted must be indicated on the forwarder’s delivery note, and a reasoned complaint must be lodged, by registered letter with acknowledgement of receipt, with the forwarder, within three days from delivery.
Warranty
All products supplied by the Domaine de la Lieutenante shall be covered by the legal warranty provided under Articles 1641 ff. of the Civil Code.
In the event of apparent defect or non-conformity of the delivered products, duly noted by the Domaine de la Lieutenante, said products may be replaced, to the exclusion of any compensation or damages.
Complaints or requests for exchange shall be made by post to the address of the Domaine de la Lieutenante - Route du Vallon - B.P. 60 071 - Saint-Martin-de-Crau cedex within thirty days from delivery.
Liability
For sales online, the Domaine de la Lieutenante shall have only an obligation of means. It may not be held liable for damages resulting from the use of the Internet such as loss of data, intrusion, virus, interruption of service or other problems beyond its control.
Personal data
Pursuant to the law relating to information technology, files and freedoms of 6 January 1978, personal information relating to the Buyer may be subjected to automated processing.
The Domaine de la Lieutenante reserves the right to collect information on the Buyer, including by using cookies. The Domaine de la Lieutenante shall not disclose information communicated by the Buyer to third parties. All personal data concerning the Buyer shall be registered and processed by the Domaine de la Lieutenante with the strictest confidentiality.
Archival storage – Proof
The Domaine de la Lieutenante shall store the order forms and invoices on a reliable, lasting medium that constitutes a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.
The computerised records of the Domaine de la Lieutenante shall be considered by the parties as proof of communications, orders, payments and transactions by and between the parties.
Settlement of disputes
These general terms and conditions of sale shall be governed by French law.
Any and all disputes shall be referred to the Tarascon commercial court, any plurality of defenders or call on guarantee notwithstanding.
